COURTS: Case against Bowser will be dropped

A Newfane man accused of trying to lure a 10-year-old girl into his car on May 1 will have the charges against him dismissed.

A judge decided there was no basis to the charge relating to an alleged abduction attempt, after reviewing the evidence and receiving a psychologist’s report.

Lockport City Court Judge William J. Watson on Monday granted an adjournment in contemplation of dismissal for Daniel G. Bowser, 24, 2991 Lockport Road.

The adjournment will run for one year, after which Bowser will not have a criminal record.

Bowser had been charged with second-degree attempted unlawful imprisonment, as well as vehicle and traffic charges.

His attorney, Christopher Privateer, said Bowser pulled over to talk to the girl because he thought she needed help.

The case has taken its toll on Bowser, the attorney said, noting the public attention has caused him grief.

“The ordeal is finally over for my client,” Privateer said. “He’ll definitely not be offering to help any children with anything in the future.”

The case began when the girl told police Bowser asked her to get in his car while she was walking to school on Price Street.

The girl told police she said no, and Bowser drove away. A crossing guard who witnessed the incident saw Bowser’s car again later that day, and he was arrested after a traffic stop.

Privateer said the adjournment in contemplation of dismissal was offered after Bowser was examined by a psychologist.

“He found he had no proclivities (toward children),” Privateer said.

Assistant District Attorney Elizabeth Donatello said the girl’s family did not wish to pursue charges any further. Bowser took care of the vehicle and traffic violations “a long time ago,” she added. Those charges were: unlawful possession of marijuana, driving without valid insurance, driving with an unauthorized window sticker and driving with the driver’s view obstructed.
