COURTS: Doxey motion to dismiss case is denied

A city man charged in connection with the death of his 13-month-old daughter had his motion to dismiss the case denied in Niagara County Court on Wednesday.
Nicholas Doxey, 23, appeared before Judge Matthew Murphy. Doxey is charged with criminally negligent homicide, a felony. He was indicted in June after a 15-month investigation into the death of Sierra Doxey, who was pronounced dead March 4, 2008.
Also charged with criminally negligent homicide is the child’s mother, Sara Nigro, 23. Nigro also appeared in court before Murphy on Wednesday, but will
have more motions to file involving her case. Both Doxey and Nigro are due again in court Oct. 9.
Emergency crews were called to the Nigro’s Garden Street apartment during the afternoon of March 4 for a report of a medical emergency involving a child. They reportedly found Sierra was not breathing.
The child was transported to Eastern Niagara Hospital-Lockport, where she was pronounced dead. Police have determined Sierra died of “acute opiate poisoning” and had high levels of morphine in her system.
Doxey’s attorney, Earl Key, has said both Doxey and Nigro believed the child died of pneumonia.
