Rapist gets 15 years

A Middleport man will serve 15 years behind bars for raping a Lockport woman at knifepoint in March.

Harold G. Case, 50, 3470 Carmen Road, was sentenced Thursday in Niagara County Court for first-degree attempted rape, a class C violent felony. Upon completion of the sentence, Case will have 15 years of post release supervision.

Speaking on behalf of the victim, Assistant District Attorney Elizabeth R. Donatello said the woman wanted the court to know what Case did to her. The victim was an close acquaintance of Case’s, who was a frequent visitor to the victim’s apartment.

Donatello said aside from the physical pain, the victim also suffered in other ways from the violent, brutal attack.

“And she will never be compensated,” Donatello said.

According to Donatello, Case used a knife and left a mark across the victim’s neck, which was visible for a few days. Case also choked the victim before raping the victim in her bedroom. He also drove by the victim’s place of employment making a gun gesture with his hand, attempting to harass the victim further, Donatello said.

“He’s been cavalier about the attack,” she said.

Case pleaded guilty at a hearing on Oct. 21. His attorney, George V.C. Muscato, said Case did regret the hurt and damage he had caused the victim. But Case did take responsibility for his actions by pleading guilty and did not minimize the seriousness of what he did, Muscato said. Case has also struggled with alcohol but did not have any prior violent charges.

Case apologized to the victim.

“I lost control, I was trying to scare her,” Case said.

Case was free on bail until he violated a court order in November by purchasing two rifles from a Lockport resident. Case was arrested and Murphy revoked the $100,000 bail, landing Case in Niagara County Jail. While in court Thursday, Case said the guns were bought as gifts for his son’s birthday.
