Schumacher DWI case adjourned to October

A Gasport woman accused of hitting two teens on Dysinger Road on May 26 will return in the beginning of October to Lockport Town Court, after having her case adjourned Tuesday night.

Amy J. Schumacher, 36, 8472 Chestnut Ridge Road, has been charged with Class E felony aggravated vehicular assault and driving while intoxicated.

On May 26, Schumacher was driving on Dysinger Road when she swerved off the road and struck two boys who were walking on the shoulder, according to the report from the Niagara County Sheriff’s Office. According to sheriff’s deputies, Schumacher registered a 0.12 percent blood alcohol content.

Matyjasik to appear in court later this month

A Lockport man facing charges related to a string of burglaries will be screened for Niagara County Court’s judicial diversion drug program.

David S. Matyjasik, 34, 6611 Ridge Road, through his attorney Peter Pecoraro requested the screening Tuesday before County Judge Matthew J. Murphy III. Matyjasik will appear again Sept. 20.

Originally facing over 10 counts, Matyjasik has the choice to accept a plea deal according to Assistant District Attorney Joseph Scalzo. The deal would allow Matyjasik to plead guilty to third-degree burglary, but he would not be allowed into the diversion program.

Bartek to be sentenced Nov. 1

A Royalton man will be sentenced Nov. 1 in Niagara County Court after accepting a plea deal Tuesday in Niagara County Court.

Nicholas J. Bartek, 23, 7919 Tonawanda Creek Road, appeared before County Judge Matthew J. Murphy III and said he would agree to plead guilty to third-degree robbery. Bartek could face state prison time, but the plea deal wipes out drug charges he had been facing.

Bartek was arrested in May following a two month investigation by the Niagara County Sheriff’s Department Drug Task Force. Instead he will serve time for a February 2010 robbery of a Stop N Gas station on Lake Road in the Town of Lockport.
