Man facing four felonies after traffic stop

Lockport Union-Sun & Journal — A Wayne County man is facing a number of charges, including four felony counts, after a traffic stop in Royalton on Saturday morning.

Thomas J. Tomasino, 36, 7727 Roder Parkway, Ontario, N.Y., was stopped on Rochester Road after a Niagara County Sheriff’s deputy spotted him driving 68 mph in a 55 mph zone. Once Tomasino was stopped, the deputy said a check of the GMC Jimmy’s registration showed the owner’s driver’s license had been suspended.

The deputy also said Tomasino appeared intoxicated and he was taken out of the car and placed in handcuffs on the driving on a suspended license charge.

A search turned up a plastic baggie containing a white powdery substance in Tomasino’s pants pocket. When asked about it, Tomasino replied, “That’s garbage.” A metal smoking pipe and a baggie of a green, leafy substance was found in another pocket and another plastic bag containing a white powdery substance, a paper envelope and a plastic straw with residue on it was found in another pocket. “That’s more garbage,” Tomasino said of the third baggie.

Deputies also found a small blue square pill in the driver’s door of the car, an open can of Four-Loco on the passenger rear floor board and an unopened 22 oz. can of Labatt Ice in the front passenger seat.

Tomasino took parts of this field sobriety test at the scene and part of it at the sheriff’s office due to weather conditions. He twice refused to take a breath test.

Tomasino was charged with driving while intoxicated, DWI following a previous conviction, first-degree aggravated unlicensed operation, second-degree aggravated unlicensed operation (alcohol related), criminal possession of a narcotic drug, criminal possession of a narcotic drug with intent to sell and speeding.

All three packages of suspected drugs field-tested positive and the combined weight of the substances was more than one eighth ounce. A county Drug Task Force detective was called in to assist on the investigation.

Tomasino was taken to Niagara County Jail on $10,000 bail and is due back today in Royalton Town Court.
