Man KO'd in Tim Horton's fight

Lockport Union-Sun & Journal —

A fight at Tim Horton's on Walnut Street resulted in a man taken to Eastern Niagara Hospital-Lockport and another man arrested Tuesday.

Robert J. McClain, 50, no permanent address, was charged with third-degree assault.

Police responded to Tim Horton's at 6 p.m. for the report of a man knocked unconscious. According to the report, police found the victim disoriented and unable to remember what happened.

A store video package showed a verbal exchange and the victim shoving McClain. McClain shoved the victim back into the tables and began punching the victim until the victim fell to the floor.

An employee heard the commotion and found the victim on the floor. McClain reportedly said, "Don't make this happen again, Joe, cause it'll be worse next time."

The victim was taken to ENH where police attempted an interview. The man was still disoriented and could not answer questions.

McClain was arrested.
