ASSAULT: Dominick J. Deflippo, 44,18 South New York St. was charged with third-degree assault and obstruction of breathing Thursday. The alleged incident happened Oct. 23 on South New York Street, police said. Officers consulted the district attorney on Thursday and it was decided Deflippo would be charged, the arrest report said. Deflippo turned himself in at 2:35 p.m. Thursday. He was arraigned by Judge William Watson and held on $250 bail.

CHARGED:  Gary R. Schwagler, 48, 2744 Main St., lower, was charged Thursday with criminal possession of a controlled substance, no seat belt and possession of a hypodermic needle. According to the arrest report, Schwagler was traveling southbound on Main Street when he was pulled over for not wearing his seat belt. There was an arrest warrant for Schwagler out of Georgia, the Niagara County Sheriff’s Office said. A deputy found a metal spoon with white residue on it and two hypodermic syringes in his pocket. The spoon was used for cocaine and the syringes are used to inject illegal narcotics, the report said. An agent found a small clear plastic bag cocaine, the report said. Gwinnett County officials said they would extradite Schwagler pending approval from their district attorney’s office.
